Everything You Need to Know About Gag Attestation Submission

Health plans are required to submit annual gag clause prohibition compliance attestations (GCPCAs) to the Department of Health and Human Services (HHS), the Department of Labor (DOL), and the Department of the Treasury (collectively, the Departments). The first GCPCA is due by December 31, 2023.

This article serves as a reference guide with detailed instructions and CMS user manual screenshots for those employers sponsoring group health plans who are required to submit GCPCAs directly to the Departments, rather than relying on their carrier/third-party administrator (TPA) to submit on their behalf.
