Webinar – The Long Goodbye: Preparing for the End of the Outbreak Period

WHAT WILL BE DISCUSSED? As you are aware, the COVID-19 National Emergency ended on May 11, 2023, and many plans elected to no longer cover COVID-19 tests, treatment, and out-of-network COVID Vaccines at no cost, resulting in a Material Modification to the plan. For clients who are subject to ERISA, plan sponsors who effected this change have 60 days from the date of this change to provide their employees a Summary of Material Modification notifying them of this change. For plan sponsors not subject to ERISA, such as government employer plans, we are recommending that you also provide the Summary of Material Modification to your plan participants due to the high profile and high utilization of these affected services during the National Emergency. The Outbreak Period also provided “tolling” or delays for many plan deadlines including, but not limited to: the period of time in which to make a COBRA election; the period of time in which to make a Qualified event election; the period of time to file and appeal; and others. The Department of Labor has confirmed that the normal plan deadlines for such actions will not longer be “tolled” or extended after July 10, 2023, which is 60 days from the end of the National Emergency on May 11, 2023.

Ben Conley is back to walk us through this information and discuss how to respond to questions from plan participants who have enjoyed the benefits of the delays through the tolling period.
